Terms of Service and BounceLinx Policies -
BounceLinx, LLC (“BounceLinx”, “Bounce”, “we” or “the company”) will provide the best possible service to our customers (“you”, “customers”, or “subscribers”). We are eager to be your wireless internet provider and give you the best option available to you at the lowest prices you can find. BounceLinx policies are listed herein, and we reserve the right to change or update these policies at any time. Subscribers will be notified via e-mail of any changes affecting the terms of their subscription.
Terms of Service
You commit to pay at the completion of your install $199 for a standard install as well as the initial one month period of service (see plans). Standard Installation is defined as a single story home with clear pathways to run cable (less than 100’) without obstructions or special material required. Additional charges may apply for non-standard installations.Examples of Non-Standard Installations include, but not are not limited to: Tripods, Antenna Masts, Chimney Mounts, Tree Mount, Tower Sections, Burying Cables, Aerial Cables, Multistory Buildings, 40-Foot Ladder Charge, Multiple Computers, and Multiple Cable Runs.If your property requires a non standard install (buried wire, bucket truck, etc) our technician will discuss the options / costs with you prior starting the install. All updated costs for late payments, reactivation or reinstall are based on our current rates (TOS). Your payment is due in advance of service each month. We assess a late fee each month your payment is 15 days late. We will deactivate your service, subject to a $39.95 Reactivation Fee, if your payment is more than 45 days late. Failure to pay after 45 days can result in the removal of ALL hardware. If you wish to reinstate service after the hardware was removed a reinstall fee will apply. You may cancel service at any time and we will collect our hardware. ALL Bounce hardware that is installed on the customer premises is the sole property of BounceLinx. If the hardware has been damaged by the subscriber and can’t be reassigned the user will be charged $199.
We offer three plans depending on total usage. BounceLinx recommends a plan level commensurate with your planned initial usage. We recommend a plan based on how many computers and the planned use. For instance, streaming video and multiple computers on-line at the same time creates a greater need. It is not expected that our clients would be in continual use 24/7 of the network nor running a business with continual online servers under one of our residential plans. You may select a plan and if your usage exceeds your plan, we will contact you with the option to upgrade to a more robust plan offering more data throughput any month we have users who desire to use more of the BounceLinx bandwidth.
Our plans are as follows: (All plans are plus $9.95 equipment rental)
Entry: 6 Mbps Down & 1.5 Mbps Up/Possible burst to 7 Mbps / 16 GB Usage $39.95*
Starter: 6 Mbps Down & 1.5 Mbps Up/ Possible burst to 7 Mbps / 100 GB Usage $59.95*
Basic: 8 Mbps Down & 1.5 Mbps Up/ Possible burst to 10 Mbps / 200 GB Usage $89.95*
Family: 10 Mbps Down & 2 Mbps Up/ Possible burst to 14 Mbps / 300 GB Usage $119.95*
Our plans include a connection to one hardwired computer- Clients can use existing wireless routers or request them from us at an additional cost.
*Once plan limits are met the customer shall be throttled to .5 Mbps down/ .5 up for the rest of the paid month. The client may at anytime upgrade the service plan.
We respect the privacy of our customers. The personal information you provide to us for broadband internet service is used solely
by us to provide you with service and to facilitate customers payment for such service.
We do not sell customer lists or any customer’s personal information to others.
We do not monitor subscribers’ internet activity or track internet e-mails.
We respect freedom of speech unless it is deemed harmful to others
We will do everything possible to protect your privacy.
Information regarding BounceLinx customers will be released only to the customer, to appropriate company employees, or to duly authorized officers of state and federal courts, or investigating authorities who provide the proper legal subpoena or other documents.
We are committed to a zero-tolerance spam policy. We prohibit spam (i.e. unsolicited mass or individualized commercial e-mail or virus) from being sent through or from the BounceLinx network by our customers. This includes selling of products that can be used in spamming applications. We reserve the right to terminate, or suspend, pending investigation, BounceLinx service, without prior notice of any subscriber disregarding this policy.
Services provided by BounceLinx may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes but is not limited to: copyrighted or trademarked material, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without the proper authorization. The subscriber agrees to indemnify and hold harmless BounceLinx from any claims resulting from the use of the service that damages the subscriber or any other party.
Account Ownership Policy
We are only responsible to the present owner of the e-mail and/or personal web space allocated to the account on Bouncelinx and contractual related entities servers through Bouncelinx network connections. Your ownership is identified by account owners full name, address, e-mail address, username, and password. If you give this information to any other party or give access to your e-mail address or personal website to any other party, you risk having your web-site and any other information in your account changed and/or deleted. We are not responsible for any information on your account should you reveal this information to another party who causes damage to your account.
Sub-hosting is not allowed on Bouncelinx servers.
Traffic and Peer-to-Peer Policy
Bouncelinx imposes very generous traffic limits that most sites never reach, unless the sites offer shareware, sound, video, image and multimedia archives, are mirror sites, or any site whose primary purposes is file distribution. Bouncelinx customers are discouraged from storing any files that cause excessive traffic on Bouncelinx servers.
We allow reasonable peer-to-peer traffic, but, in fairness to other subscribers on the network, prioritize it below most other uses when network activity is high. We reserve the right to charge additional fees or suspend services without prior notification if customers exceed generous traffic limits without prior purchase of add-on data plan package.
You agree to indemnify Bouncelinx for all your acts and omissions. You agree to indemnify, defend and hold harmless Bouncelinx, its affiliates, officers, directors, employees, consultants, agents and representatives from any and all third party claims, losses, liability, damages and/or costs arising from your use of the service, your violation of the Terms of Acceptable Use or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity.
There is a $400.00 cancellation fee of Bouncelinx service. Equipment will need to be returned including radio, antenna, power supply and any other related equipment supplied by Bouncelinx for service.
